Fair Use Policy

This Fair Use Policy applies to all Gardeo plans and ensures that all users can enjoy reliable, high-quality service. It supplements our Terms of Service.

1. Purpose

Some Gardeo plans include access to features described as 'unlimited' or without explicit numerical caps. This Fair Use Policy defines reasonable usage boundaries to protect service quality for all users and prevent abuse.

2. Usage Guidelines

Fair use means using the Service in a manner consistent with normal business operations for your organization's size and plan. The following are considered outside fair use:

• Automated bulk requests that significantly exceed typical human interaction patterns (e.g., scripted mass-generation of content without human review).
• Using a single account or organization to provide AI services to unrelated third parties, effectively reselling the Service.
• Deliberately circumventing rate limits, usage monitoring, or quota enforcement mechanisms.
• Sustained usage patterns that consume disproportionate infrastructure resources relative to your plan tier, negatively impacting service quality for other users.
• Creating multiple accounts or organizations to circumvent plan limitations or obtain additional free trial periods.
• Using the Service primarily for benchmarking, stress testing, or competitive analysis without prior written consent.

3. Monitoring and Notification

We monitor aggregate usage patterns to ensure service quality. We do not inspect the content of your prompts or outputs for fair use enforcement.

If your usage significantly exceeds typical patterns for your plan, we will contact you to discuss the situation before taking any action. We aim to resolve fair use concerns collaboratively and will provide at least 14 days' notice before any service restriction.

4. Consequences

If usage cannot be resolved through discussion, we may: suggest a more appropriate plan, apply temporary rate limits to normalize usage, or, as a last resort, restrict or suspend access in accordance with our Terms of Service.

We will not retroactively charge for past usage that exceeded fair use guidelines. Any changes to your plan or pricing will apply prospectively only.

5. Enterprise Customers

Enterprise customers with custom agreements may have individually negotiated usage terms that supersede this Fair Use Policy. Specific usage allowances, SLAs, and dedicated resources are defined in your Enterprise agreement.

6. Changes to This Policy

We may update this Fair Use Policy from time to time. Material changes will be communicated at least 30 days in advance. The continued use of the Service after changes take effect constitutes acceptance of the updated policy.
